The Tune Up Tournament Official Rules

The Tune Up Tournament (the “Contest”) taking place from January 22nd, 2022 through January 23rd, 2022 is subject to these Official Rules (“Official Rules”), which are binding and final on matters relating to the Contest, except as expressly stated otherwise. No purchase necessary to enter or win. The Contest is sponsored by Exxon Mobil Corporation (the “Sponsor”) & administered by Gen.G (the “Organizer”).

  1. How to Enter (3v3): Register as a team of three (3) online on the tournament page and click “Complete Registration” (an “Online Entry”).
  2. How to Enter (1v1): Register yourself online on the tournament page and click “Complete Registration” (an “Online Entry”).

The Tune Up Tournament will take place online. There is no charge to register for the Tournament. Registration will open on January 11th, 2022 at 9am PT, and all online entries must be received by 11:59PM (ET) on January 21st, 2022 to be eligible to participate in the tournament. The Organizers and Sponsors are not responsible for: (i) late, lost, stolen, damaged, garbled, delayed, postage due, misaddressed, or misdirected entries or mail; (ii) technical, hardware or software malfunctions, lost or unavailable network or internet connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest; (iii) the incorrect or inaccurate capture of information whether caused by Website users, tampering, hacking or by any equipment or programming associated with or used in the contest; (iv) errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the Tournament; (v) theft, loss, or destruction of, or damage to, an Online Entry, in whole or in part; (vi) electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in a team member’s email account to receive email messages, and (vii) any other factors beyond the reasonable control of the Organizers and Sponsors. Each team member assumes all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected Online Entries. Each team must be registered separately.

    3.1. 3v3

    1. All teams will be randomly seeded following the close of registration. Seeds are done in ascending order with Seed 1 being the highest seed. The higher seeded team at the start of each game must host the game and will have the choice of being the home or away NBA2K team. Teams will play their scheduled game(s) during a scheduled window of time provided by Organizers.
    2. NBA2K 2022 gamemode will be 3v3 Park. Players will be allowed to change their controller settings within the Options menu of NBA2K 2022 before the start of each game.
    3. The Tournament will be a single elimination tournament featuring best of one (1) games until the semi-final round. The semi-final and championship rounds will be best of three (3) games.

    3.2. 1v1

    1. All players will be randomly seeded following the close of registration. Seeds are done in ascending order with Seed 1 being the highest seed. The higher seeded player at the start of each game must host the game and will have the choice of being the home or away NBA2K team. Players will play their scheduled game(s) during a scheduled window of time provided by Organizers.

    3. The Tournament will be a single elimination tournament featuring best of one (1) games until the semi-final round. The semi-final and championship rounds will be best of three (3) games.

    3. 3rd/4th - 600,000 Virtual Currency (ARV $150)

    4.2. 1v1

    1. 1st - $2,000
    2. 2nd - $200
    3. 3rd-8th - 75,000 Virtual Currency (ARV $20)
  3. Eligibility: The Tournament is open to individual legal residents of the fifty (50) United States who are 18 years of age or older.
  4. Winning a Game, Progression, and Selection of Winners: The winner of each game in the Tournament will be the team with the most points at the end of the game. In the event that a particular game ends in a tie, the game will go to overtime and the team with the most points at the end of overtime(s) will win that particular game. The Tournament(s) will be in a single elimination format. In this format, a team that loses a game will be eliminated from the Tournament. All teams will attempt to progress to the semifinal and championship rounds which will be the best of three (3) games. The finals will be played between the last two remaining teams. In order to win the Grand Prize, a team must win the finals. The prizes may not be transferred or substituted. No more than the advertised number of prizes will be awarded.
  5. Verification of Winners and Delivery of Prizes: Winners may be required to sign an Affidavit of Eligibility and Liability Release and, where permitted, a Publicity Release. Prizes may be awarded to the runners up of the Tournament if: (i) a required Affidavit/Release is not returned to Organizer within ten (10) days after mailing to winners; (ii) winners fail to meet the eligibility requirements set forth in Section 3; (iii) the prize notification letters or prizes are returned as undeliverable; (iv) two (2) attempts to contact winners by phone and/or social media account are unsuccessful; or (v) or winners decline the prizes.
  6. Disputes: Disputes regarding these Official Rules and/or this Sweepstakes will be governed by the internal laws of the State of California. Decisions of Organizer and Sponsor are binding and final. No claimant in any dispute involving Organizer and Sponsor shall be entitled to claim or obtain indirect, punitive, incidental or consequential damages.

Organizer and Sponsors reserve the right to cancel, terminate or modify the Tournament should any virus, bug, tampering, technical failure, unauthorized human intervention or other cause beyond Organizer and Sponsors’ control corrupt or affect the administration, security, fairness or proper conduct of the Tournament. The Organizer and Sponsors are not liable to a winner or to any other person for failure to supply the prizes described herein (or any part thereof) by reason of such prizes (or any portion thereof) becoming unavailable or impracticable to award for reasons beyond the reasonable control of the Organizer and Sponsors, or for any force majeure event, technical or equipment failure, terrorist acts, labor dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause beyond the reasonable control of the Organizer and Sponsors. Team members agree to hold harmless and indemnify Organizer and Sponsors, Gen.G Esports, Exxon Mobil Corporation, and each of their respective parent organizations, subsidiaries, affiliates, directors, officers, owners, advertising and promotion agencies, and agents (collectively, the “Indemnified Parties”) from any and all liability, loss or damages or causes of action arising from or in connection with each team members’ participation in or winners’ receipt or use of the prizes awarded in the Tournament. Team members agree to the use of their name, likeness, biographical data, and/or voice in any and all advertising, promotions, and other publicity conducted by the Indemnified Parties without additional authorization, compensation or remuneration to the extent permitted by law. Organizers are responsible only for delivery of prizes, and not for use, utility, quality or otherwise. By signing up for this Sweepstakes, you agree to be contacted by Sponsor. THE TUNE UP SWEEPSTAKES OFFICIAL RULES

The Tune Up Sweepstakes (the “Sweepstakes”) is subject to these Official Rules (“Official Rules”), which are binding and final on matters relating to the Sweepstakes, except as expressly stated otherwise. No purchase necessary to enter or win. The Sweepstakes is sponsored by Exxon Mobil Corporation (the “Sponsor”) & administered by Gen.G (the “Organizer”).

  1. How to Enter: Entrants can enter the sweepstakes by signing up on the page during each Sweepstakes period (“Submission”). Any attempt by any person to obtain more than the stated number of Entries by using multiple/different accounts, or any other methods including, without limitation, script, macro or any automated or other means which subverts the entry process, will void all of that person’s entries and that person will be disqualified. Any user not using their main social account for entry (I.E. Giveaway accounts), will void all entries and cannot win these sweepstakes.
  2. Eligibility: The Sweepstakes is open to anyone aged 18 years or older residing in North America (“Entrant”). Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Organizer and Sponsor are not eligible to participate or win a Prize. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. By participating, entrants agree to these Official Rules and the decisions of the Organizer and Sponsor, which are final and binding in all matters related to these Sweepstakes.
  3. Sweepstakes Periods: The sweepstakes periods are listed below. There are four (4) total sweepstakes periods. Entries must be received during their respective sweepstakes period to be eligible to win.
    • January 11th, 2022 at 9am PT until February 1st, 2022 at 11:59pm PT.
    • February 8th, 2022 at 9am PT until March 22nd, 2022 at 11:59pm PT.
    • April 5th, 2022 at 9am PT until April 26th, 2022 at 11:59pm PT.
    • May 3rd, 2022 at 9am PT until May 24th, 2022 at 11:59pm PT.
  4. Odds: Odds of winning a prize depend on the number of eligible entries received.
  5. Prizes: If eligible under these Official Rules, one (1) randomly selected Entrant per Sweepstakes period will receive a Playstation 5 (Approximate Retail Value $500) and a coaching/play session with one of the Gen.G Tigers of Shanghai. In addition, ten (10) randomly selected Entrants per Sweepstakes period will receive a $20 NBA2K22 VC Code (ARV $20) on the platform of their choice.

    In total, four (4) Playstation 5’s (ARV $2000), forty (40) $20 NBA2K22 VC Code (ARV $800), and four (4) sessions with members of the Gen.G Tigers of Shanghai will be distributed to entrants. (Total Approximate Retail Value $2,800).

Selected Entrants are not entitled to any surplus between actual retail value of prize and approximate retail value and any difference between approximate and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, or cash for any portion of prize not used, provided however that Organizer and Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. If a selected Entrant does not want a portion of the prize, that portion is forfeited. All additional costs, including taxes, are the sole responsibility of selected Entrants.

  1. Submission Criteria:
    • Submissions must be submitted according to the How to Enter section.
    • Submissions must be directly accessible by Organizer and Sponsor.
    • Organizer and Sponsor may require verification of Submissions through a procedure solely determined by Organizer and Sponsor at their sole discretion.
    • Organizer and Sponsor reserves the right to exclude any Submission that it believes, in its sole discretion, doesn't meet this criteria or otherwise violates these Rules, and to delete or otherwise remove any such Submission from any and all location(s) under Organizer and Sponsor’s control.
  2. Winner Selection and Notification of Selected Entrants:
    • Eleven (11) Entrants residing in North America will be selected at random by a representative of Organizer from among all eligible entries received during a given Sweepstakes Period the day after the Sweepstakes period closes.
    • Selected Entrants will be notified by email, phone, or via the platform through which the Submission was made, according to Organizer and Sponsor’s sole discretion and with the information provided at the time of entry. Selected Entrants will be required to respond (as directed) within three (2) days of attempted notification. The failure to respond within three (2) days to the notification may result in forfeiture of the prize and, in such case Organizer and Sponsor may randomly select an alternate Selected Entrant from among the remaining eligible entries. Selected Entrants may also be sent a declaration of eligibility / liability / publicity release (“Release”). Unless restricted by law, Selected Entrants will be required to complete and return the Release within five (3) days from the date of notification. An alternate Selected Entrant may be randomly selected from among the remaining eligible entries if a Selected Entrant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason.
  1. Privacy: The information you provide will be used only in accordance with Organizer and Sponsor’s privacy policy, located at https://geng.gg/pages/privacy and https://corporate.exxonmobil.com/Global-legal-pages/privacy-policy.
  2. Publicity: Organizer and Sponsor reserves the right to use the name, likeness, and/or account ID of any Entrant, for publicity purposes prior to, during, or after the Sweepstakes end date, in any media, throughout the world, in perpetuity, but only in connection with publicizing the Sweepstakes, without any compensation or prior review unless specifically prohibited by law.
  3. General Conditions: By participating, Entrants agree to be fully and unconditionally bound by these Official Rules and the decisions of Organizer and Sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Any portion of the Sweepstakes may be canceled, suspended and/or modified, in whole or in part, if in our opinion any fraud, technical failure or other factor beyond our control impairs the integrity or proper functioning of the Sweepstakes. Organizer and Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Organizer and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Entrants may not enter with multiple identities or use any automated system, bot or other device or artifice to enter or obtain more than the maximum number of qualified entries. Organizer and Sponsor reserves the right at its sole discretion to terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) in a random drawing from among all eligible, non-suspect entries received prior to action taken. Unclaimed prizes will not be awarded. All federal, state or other tax liabilities (including income taxes) arising from this Sweepstakes will be the sole responsibility of Selected Entrants. Entrants may be issued an IRS Form 1099 for the ARV of any awarded prize. Any attempt to deliberately damage or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws and will result in disqualification from participation in the Sweepstakes. Should such an attempt be made, Organizer and Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.   4. Limitations of Liability: Selected Entrants agree to release, discharge, indemnify and hold harmless Organizer and Sponsor and each of their respective officers, directors, employees, representatives and agents (collectively “Releasees”) from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: (i) use, redemption, acceptance, possession, ownership, or misuse of any prize, (ii) participation in any activity, event, or excursion offered in connection with the prize, (iii) use of any facility, service and/or accommodation related to the prize, or (iv) participation in any Sweepstakes-related activity or participation in this Sweepstakes. The Releasees shall not be liable for: (i) late, lost, delayed, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or declarations, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Without limiting the generality of the foregoing, Releasees are not responsible for computer malfunctions, network connections, email delivery problems, systems failure or incompatibility, typographical, technical or keystroke errors, or interruptions in your internet service, and for incomplete, illegible, misdirected, misprinted, late, lost, damaged or stolen notifications.

In the event Organizer and Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, or any federal, state or local government law, order, or regulation, or other cause not reasonably within Organizer and Sponsor’s control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Organizer and Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Organizer and Sponsor’s failure to enforce any provision in these Official Rules shall not constitute a waiver of that provision.

Sweepstakes Results: For Sweepstakes results and/or a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope (stating the specific Sweepstakes you are requesting the winners for) to Gen.G Esports, 1615 16th Street, Santa Monica, California 90404. Requests must be received within 90 days of the end of the Sweepstakes.

Privacy Statement: Your privacy is important to the Organizer and Sponsor. This privacy statement provides information about the personal information that the Organizer and Sponsor will collect, and the ways in which the Organizer and Sponsor uses that personal information for the facilitation of the Contest.

Personal information collection: The Organizer and Sponsor collects and uses the following kinds of personal information: First and Last Name, Email, Phone Number, and Oil Change Preferences.

Using personal information: The Organizer and Sponsor will not sell or rent your personal information to third parties for marketing purposes without your express authorization. The Organizer and Sponsor may use your personal information to: Administer the Contest; Contact you for Contest operations purposes; Ensure that you are 18 years of age or over; Post on social media your gamertag upon winning Contest; Send you prizes for winning Contest, Contact you for future related Contests.

How do you get my consent? When you provide us with personal information to register for the Contest, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent? If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at jbauer@geng.gg.

Disclosure: We may disclose your personal information if we are required by law to do so or if you violate our Rules.

Security: To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Third-Party Services: In general, the third-party providers used by the Organizer and Sponsor will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us for the facilitation of the Contest.
